Understanding Criminal Law in Florida

You will be charged with a crime in Florida if law enforcement officials believe that you have violated an established state law. Florida crimes are divided into two basic categories: misdemeanors and felonies.

Misdemeanors

Of the two types of crimes, misdemeanors are the least serious. Misdemeanors in Florida are broken down into two categories: Misdemeanor in the First Degree and Misdemeanor in the Second Degree. A Misdemeanor in the Second Degree carries a penalty of up to 60 days in prison and a fine of up to $500, while a Misdemeanor in the First Degree carries a more severe penalty of up to one year in prison and a maximum fine of $1,000.

Felonies

A felony is the most serious crime you can commit in Florida. Felonies in this state are classified into five different categories: Felony in the Third Degree, Felony in the Second Degree and Felony in the First Degree, Life Felony and Capital Felony. Capital Felony is the most serious of these charges, while Felony in the Third Degree is the least serious. Charges vary based on the severity of the crime and range from fines and prison time to the death penalty.
